Ethics courses often provide social workers with strategic decision-making frameworks for analyzing ethical dilemmas. Although these frameworks help individuals make think critically, they do not provide guidance on how to manage conflicts when social workers, clients, and other stakeholders disagree about the most ethical course of action. This workshop demonstrates a conflict resolution approach to managing challenging ethical dilemmas, including situations where social workers have conflicting obligations under the NASW Code of Ethics. Participants will learn specific interest-based strategies and skills that they can use to foster consensus with clients, co-workers, clients, and others affected by ethical issues. In particular, this session will highlight resolution of ethical issues related to conflict of interest, client self-determination, confidentiality, safety, mental capacity, and professional competence.

    Objectives:
    • Participants will learn how to analyze the nature of ethical conflicts, distinguishing conflicts based on miscommunication, differing positions, power, rights, and interests.
    • Participants will learn how to build consensus by focusing on interests, not positions, and working toward common ground on issues related to value conflicts, self-determination, confidentiality, safety, mental capacity, and professional competence.
    • Participants will learn how to generate and assess creative options for managing challenging ethical issues related to value conflicts, self-determination, confidentiality, safety, mental capacity, and professional competence.
    • Participants will learn how to identify constructive forums for managing challenging ethical issues.
