Whether just starting out or decades into your social work career, you could always use a refresher on the legal topics that most impact the profession. In 2025, the NASW Legal Defense Fund Helpdesk received over 800 calls, with the majority of questions related to three categories: access to records, board complaints, and working with child clients. In this presentation, Ashlee Fox, JD, MSW, and Frances Schopick, JD, MSW, will take you back to the basics to learn all you need to know about these integral aspects of social work practice. First, we will discuss access to records, including third party requests, unauthorized access allowed under HIPAA, and legal requests for client records. Next, we will review licensing board complaint procedures, Frances Schopick’s area of expertise. Her legal practice focuses on representing licensed professionals who have had complaints filed against them. Lastly, we will examine the legal framework for treating minor clients. Our discussion will review informed consent and record access, and examine when minors are allowed to consent to their own treatment. Make sure to bring your notebook and pen to this study session you won’t want to miss.
